Imphal september 15, 2014: The High Court of Manipur has issued a ruling saying that Government officers who have retired on superannuation at the age of 60 should not be re-engaged in any Government job.

The High Court has also quashed a Government order which extended service period of Health Director Dr A Bijoy.

The landmark judgement was passed by High Court of Manipur Chief Justice LK Mohapatra on September 2 in connection with a petition filed against re-engagement of retired Health Director A Bijoy for another six months.

The petition was filed by Family Welfare Additional Director Dr K Rajo and the case was heard on August 29, informed a source.

The judgement which would have wide ramifications on the policy of the Government of Manipur regarding extension/re-engagement of retired persons on substantive or key posts remarked that such extension/re-engagement of retired officers is against Fundamental Rule 56 (d).

Notably Fundamental Rule 56(d) says that “No Government servant shall be granted extension in service beyond the age of retirement of sixty years.”

In accordance to an agreement between the Government of Manipur and Dr A Bijoy Singh, the latter was re-engaged as Director of Health Services on contract basis for six months with effect from March 1, 2014. However, the agreement has been annulled by the High Court of Manipur.

The High Court further directed the State Government to consider appointment of complainant Dr Rajo as Director in-charge of Family Welfare Department.

Notably, many retired officers have been working in different departments after their service periods were extended.

The High Court order further pointed out that re-engagement or service extension block the chances of other qualified incumbents from getting their due promotion.

Family Welfare Additional Director Dr K Rajo was represented by Advocate Dr RK Deepak as the petitioner’s counsel.
